What are our UK work visa options?

Americans do not generally need a visa to come to Britain as a Visitor for up to six months for purposes such as tourism, visiting friends or family, short study courses or certain permitted business activities. We advise on permitted activities include negotiating contracts, site inspections or promoting business at trade fairs. Though you may not need a visa, you must fill out the new Electronic Travel Authorisation (ETA) – much like the US ESTA.
 


To live and work in the UK these are the major options below. Contact us today to see which you or your employees may qualify for.

If your business is trading in the UK and you have at least one worker settled in the UK who can operate a sponsor licence, we can help you apply for one to sponsor and employ qualified skilled workers to come to the UK. There are salary and skills thresholds that must be met. 

Route to settlement: After five years.

Dependent family members permitted: Yes (NB: Dependants include a married spouse, partner and children under 18).

If your organisation doesn’t yet have a branch or subsidiary in the UK or workers here, it may send staff to establish a UK commercial presence.  To obtain an Expansion Worker sponsor licence, we help you demonstrate you have been active and trading for at least three years and have a credible expansion plan, including sufficient market research and funds for expansion. This route has replaced the Representative of an Overseas Business visa.

Route to settlement: No – a 12-month Expansion Worker visa can be extended once for a further 12 months. However, this work visa allows switching into other categories such as Skilled Worker.

Dependent family members permitted: Yes.

Graduates (within the last five years) from top global universities may apply to come to the UK on an HPI visa. The list of qualifying colleges is published every November and around half are American institutions.

Students accepted by a Home Office licenced university can apply for a student visa for the duration of their course. Some work is permitted, though not on your own business. Once you have successfully completed your graduate or postgraduate study you can apply for a Graduate visa, allowing you a limited period to stay in Britain and work, including on your own business.

Route to settlement: No. Switching to a work visa is allowed, but only after a course has been successfully completed.

Dependent family members permitted: Only student visas for a PhD, doctorate or research-based higher degree. Dependants can join you on a Graduate visa if they were already in the UK on your Student visa.

Due to changes introduced in 2022, those born in the USA before 1988 may now be able to claim British citizenship if their mother or grandparent was born in the UK.  

The USA allows dual nationality, so British citizenship registration under this provision does not interfere with existing US citizenship.

Route to settlement: Direct to British citizenship.

Dependent family members permitted: Family members can then be sponsored on a Family visa.

Founders and founding teams intending to launch in the UK market may apply for this visa which has replaced the Innovator and Start-up visas. The business must be assessed by a Home Office licensed endorsing body as being viable, innovative and scalable. 

Route to settlement: Potentially after three years if the business has met certain targets, otherwise it can be renewed or we can advise on whether switching to another route works best.

Family members permitted: Yes

Founders and founding teams intending to launch in the UK market may apply for this visa which has replaced the Innovator and Start-up visas. The business must be assessed by a Home Office licensed endorsing body as being viable, innovative and scalable. 

Route to settlement: Potentially after three years if the business has met certain targets, otherwise it can be renewed or we can advise on whether switching to another route works best.

Family members permitted: Yes

We help many recognised talents in the fields of academia or research, entertainment, arts and culture or digital technology apply for endorsement as a leader or potential leader in the field allowing application for a Global Talent visa which allows you to work and live in the UK with no need for a job offer.

If we can demonstrate proven commercial, investment, or product expertise in building digital products or significant digital businesses you may also qualify for the digitech stream of the Global Talent visa.

Route to settlement: After three years (five years for emerging talent).

Dependent family members permitted: Yes.

We advise on sponsor licences and visas for the Temporary Work – Creative Worker route for short-term work in the UK for up to 12 months within the creative sector.  There will be various requirements that we can advise on, for example, demonstrating Creative Workers are internationally renowned or required for continuity in a production. For three months or under a visa may not be required, but Americans still need an ETA.

Route to settlement: No, but you can extend your stay up to two years with the same employer, or 12 months if changing employers. 

Family members permitted: Yes

British nationals and UK permanent residents may sponsor a significant partner, fiancé(e), spouse, civil partner, unmarried partner or children to be with them in the UK. 

If you are joining a loved one on a spouse or partner visa there are minimum income requirements. 

Route to settlement: After five years.

Frequently Asked Questions (FAQs)

Dual and multiple citizenship is permitted under both UK and US law. US citizens are required to enter and exit the United States using a valid US passport and you should use your UK passport to enter and leave the UK.

To apply for British citizenship, you will need to obtain permission to remain in the UK until your application is granted. You will also need to pass requirements such as the Life in the UK test, which assesses your knowledge of UK life, history, and current affairs.

To employ workers who aren’t settled in the UK, in most cases you will need to sponsor them for a work visa. The Skilled Worker visa replaced the Tier 2 visa in 2020 as Britain’s most common work immigration option. As well as a work permit it is a five-year route to settlement.

We have an impeccable track record of successful applications for Skilled Worker sponsorship as well as for other lesser-used immigration options for working in the UK.

Immigration advice should feature early in the process to avoid inadvertently losing access to visa routes or running into delays at critical junctures down the line. Current UK immigration changes may change your options, so the UK’s immigration rules should be a consideration at a very early stage of the process.

Some visas may require a sponsor licence or endorsement first, which is why it is crucial to always plan ahead. Understanding our visa routes is essential – especially as some such as Skilled Worker or Scale-up, are only available once a company has begun trading in the UK, while the Expansion Worker route is an option if you are not.

Most applications are processed within eight weeks. Paid priority services are available to reduce this to 10 working days.  Decisions may be delayed if the Home Office decide to conduct a pre-licence audit on your business, though this is unlikely in most sectors.

Allow time to prepare supporting documents and information to support your application.  For example, if you create a new company, it can take a while to establish a UK bank account.

You can request an allocation of ‘undefined’ CoS when making your sponsor licence application based on how many you anticipate needing so that the certificates are ready when your licence is approved. These may be used to sponsor immigrant workers already in the UK. 

For new hires from overseas, you must apply to the Home Office for ‘defined’ CoS – specific to the role you want to fill with a sponsored worker. These ‘DCoS’ applications are decided on a case-by-case basis and usually within two days unless the Home Office has further questions about the role.

For workers applying from overseas, standard processing is three weeks. For workers applying to extend visas or switch employers, standard processing is eight weeks. Paid priority services are available from the Home Office and their commercial partners overseas which can expedite the process down to one to five working days.

Until recently, sponsors had to renew their licence every four years, but this is no longer necessary as they no longer have expiry dates.

However, Scale-up and UK Expansion Worker licences are only valid for four years because these are time-limited and cannot be renewed. (The UK Expansion Worker licence can only be actively used for two years). We advise on when it is prudent to apply for more than one sponsor licence and when to add other licences to your existing one.

If you are facing revocation or downgrading of your sponsor licence, we encourage you to instruct us as soon as possible so we can assist with the next critical steps you take.

We will review the grounds of any decision, challenge any factual errors, advise you on required supporting evidence and support you with presenting a response to the Home Office. 

Refusal or revocation unenviable situations to be in, but we have a lot of experience in helping sponsors who come to us in such trying situations.

Applicants need to be leaders or potential leaders aged 18 in academia, research, digital technology or arts and culture. To be eligible to apply for the visa you must either be endorsed by the relevant endorsing body for your field by fulfilling their requirements or have won qualifying awards on the Home Office’s list of prestigious prizes. 

Endorsing bodies typically take between four and eight weeks. After that, visa decisions are usually about three weeks outside the UK or around eight weeks in the UK. Paying extra for priority applications can speed up a visa decision to five working days or next working day for super priority. 

For science and research: the Royal Society, Royal Academy of Engineering, British Academy and UK Research and Innovation. 

Arts and culture: Arts Council England, Producers’ Alliance for Cinema and Television (Pact), Royal Institute of British Architects (RIBA) and British Fashion Council.

Digital technology: Tech Nation. 

Five years on most work and family visas will currently allow an application to settlement, subject to all the eligibility requirements being met, though some routes are shorter and in certain cases, it can be ten years. However, the UK government is currently holding a consultation on increasing the current five years in more cases.
