While many of us were celebrating New Year’s Eve, the Home Office recently published a number of significant changes to their guidance for work sponsors affecting employers currently sponsoring migrant workers and those intending to. Senior Client Manager Ross Kennedy‘s article in Free Movement (see link below) outlines these important changes for sponsors.
The key changes are:
- New restrictions on which sponsorship costs an employer may pass on to the employee – this will affect clawback agreements between employers and sponsored workers.
- “Person with Significant Control” is added to the list of people whose circumstances may impact your ability to sponsor migrant workers.
- Significant changes to rules on key personnel a sponsor must have which will affect new sponsor licence applications and could present obstacles to some prospective sponsors.
- New restrictions for sponsorship in a personal capacity – these mainly relate to the sponsorship of workers in private households (such as nannies).
